Though the decision may not have been in favour of Christian Louboutin and his 'signature' red soles, the luxury label has not given up hope yet.
Earlier in the year the footwear specialists asked the courts to sign a preliminary injunction to prevent Yves Saint Laurent and other shoe makers from using their now famous if not unofficial red bottomed shoe.
While they await to see if the initial decision has been overturned, support has come from an unlikely source, adding backing and validity to their case, in Tiffany & Co.
The designer jewellers may not have any direct decision in the Louboutin case, but fear that if the decision to reject their request is upheld, then this may lead to scrutiny of other companies having signature colours too.
In 1998, the decision was made to allow Tiffany's to trademark their now famous signature blue packaging and fear that if a court says that Louboutin cannot have their red soles, the Tiffany's cannot have their beloved blue boxes.
The ruling decision for Louboutin's appeal is expected sometime in the new year.
