The couple got married on 27 th August 2005 and have one child together, Exton Elias Downey. The pair got together one year after Downey's divorce to Deborah Falconer in 2004 whom he was with for 12 years.

Downey also has a child to his first wife, called Indio Falconer Downey, who was born in 1993.
Downey married Gothika producer Levin in a Jewish ceremony at Amagansett in New York after the couple met on the set of the film and he proposed to her one her 30h Birthday.
Sting and Billy Idol performed at the couple's wedding, whom Downey performed with on the soundtrack to Ally McBeal singing 'Every Breath You Take' in a duet.
Levin turned down Downey's advances twice before agreeing to date him and the pair kept their relationship quiet while on the set of Gothika. Levin was skeptical about how long the relationship would last given the strain on Hollywood romances.
Downey has a tattoo reading 'Susie Q' on his bicep in a tribute to his wife and often publicly thanks her for helping him through his darker times of drug and alcohol abuse.
