Police launched an investigation after the 24 star was accused of assaulting Jack McCollough at a Met Costume Institute Gala after party on Tuesday (05May09) night.
Sutherland reportedly flew into a rage with McCollough after he bumped into actress Brooke Shields at SoHo nightspot SubMercer.
McCollough claimed Sutherland, star of Fox television's "24," attacked him after an argument, according to a law enforcement official who spoke on the condition of anonymity because the investigation is ongoing.
And now the actor has been told to show up at a New York police station and get a desk appearance ticket for an upcoming arraignment date.
Sutherland is currently under a probation order in Los Angeles relating to his 2007 conviction for driving under the influence (DUI).
He spent 48 days in jail but could be sent back to prison if he is found to have violated the terms of his release by fighting with McCollough.
An official said detectives plan to question Sutherland before the end of this week and might question actress Brooke Shields as a witness, but nobody has been arrested.
Representatives for Sutherland, McCollough and Shields weren't returning calls as FemaleFirst went to press.
Sutherland was released from a Glendale, Calif., jail last year after serving 48 days on a drunken driving charge. He had pleaded no contest to driving with a blood-alcohol level above the legal limit of 0.08 percent. He was sentenced to 30 days, as well as 18 days for violating probation in a 2004 drunken driving arrest.
