The 40-year-old actor has filed for divorce from the 31-year-old model - who he married under the radar in Los Angeles in June 2012 - citing irreconcilable differences in the court documents, which have been obtained by gossip website TMZ.
The documents claim the pair separated on December 28 but the 'Selma' actor filed for divorce earlier this month.
Just months after the pair's wedding, which took place at Los Angeles County Registrar and was said to have come as a shock to her friends and family, the blonde star admitted she was overjoyed at being Giovanni's wife.
She said: "I love being a wife. We've known each other for a while. But when you know, you know... He's f***ing awesome."
And in 2013, Agyness admitted the wedding - which was her first - felt right because she knew she had met the right person in Giovanni.
Speaking about her marriage, she said: "I don't know. I suppose you meet someone and you're just like ... you know.
"Obviously, if someone's marrying someone, they're bringing a lot of really good stuff ... So..."
Giovanni was previously married to Mariah O'Brien - who he has daughter Lucia with - for four years until their divorce in 2001 and he also went on to date singer/songwriter Cat Power.
