A man once accused of plotting to kidnap the son of U.S. talk show host David Letterman has been denied an appeal.
In 2005, Frank Kelly was suspected of plotting to snatch the comic's young son from his ranch in Montana but the charges were ultimately dropped.
Kelly was then put behind bars for 10 years for overcharging Letterman for painting work at the ranch.
The convict was then sentenced to another 10 years for breaking out of a state prison in June 2007. He was recaptured six days after breaking free.
On Tuesday (19May09) the 47 year old appealed the escape conviction, but the state Supreme Court rejected his bid.
Frank is next eligible for parole in May 2011.
