Cheech Marin's ex-wife has had her request for an immediate restraining order against the comedian rejected by a U.S. judge, despite accusing the star of domestic abuse.
Patti Heid, who wed the Cheech & Chong funnyman in 1986, claims relations turned nasty after she refused to sign a legal document regarding the transfer of property.
According to court papers, Marin paid a visit to her property and is alleged to have verbally attacked her for reneging on their agreement and threatened his ex with legal action.
Heid accuses the actor of following her into her home, stating, "(He) fractured my cheek, blackened my eye and violently choked me, causing severe bruising on my neck and neck pain... numbing of my arms and hands."
Marin, 64, is also said to have placed his hands around their son's neck, too, according to TMZ.com.
The case went before a judge this week (begs31Jan11), but the request for an immediate restraining order was denied and the matter was set for another hearing later this month (Feb11).
The comedian, who is now married to classical pianist Natasha Rubin, has yet to respond to the allegations.
