Don McLean and his wife have agreed to dismiss an order of protection case following his arrest for domestic violence.
The 'American Pie' singer was arrested last Monday (18.01.16) on a misdemeanour charge and photographer Patrisha McLean
filed a handwritten request for protection.
However, the couple have now "agreed to move forward" and dismiss the order of protection case, attorney Walter McKee said.
He added: "Neither party is seeking divorce. This now becomes a private matter."
He also confirmed his client will be pleading not guilty in the criminal case.
Patrisha said in a statement she "did not intend to define Don or our relationship" with the protection order and asked her fans not to focus on her spouse's court case.
She wrote in a statement: "Don has a big heart. He and I had many happy times in the 30 years of our marriage and what has recently transpired is unfortunate for all of us."
Patrisha's original request for protection stated she feared for her life due to her husband's rage when she called police and documented abuse going back decades.
Following his arrest, Don - who lives in Camden, Maine, with his wife - recently insisted he is "not a villain" and suggested his marriage was on the rocks.
He tweeted: "This last year and especially now have been hard emotional times for my wife, my children and me. What is occurring is the very painful breakdown of an almost 30 year relationship.
"Our hearts are broken and we must carry on. There are no winners or losers but I am not a villain.
"I may never recover from this but I will try and hope to continue to entertain you all as I always have. I ask God to give us the strength to find new happiness and I hope people will realise that this will all be resolved but I hope I will not be judged in this frantic media environment."
