A tribunal panel has ruled that it infringes human rights and compared it to commenting on the size of a woman's breasts.
Baldness relates to sex as men are far more likely to lose their hair than women, according to the panel - which was ironically made up of three follically challenged men.
The ruling came in the case of Tony Finn, who was called a "bald c***" by his boss Jamie King during in a row.
Finn argued that the comment amounted to sexual harassment under the Equality Act 2010 because it targeted his gender.
The panel said: "There is a connection between the word 'bald' on the one hand and the protected characteristic of sex on the other.
"Women may as well be bald.
"However, as all three members of this panel will vouchsafe, baldness is much more prevalent in men than women.
"We find it to be inherently related to sex."
